Should you appeal your photo radar ticket?

The question whether to appeal your photo radar ticket comes up often after a person is found responsible for their ticket...and we would like to help. REMEMBER, YOU CAN ONLY APPEAL IF YOU HAVE BEEN FOUND RESPONSIBLE! You cannot appeal before then, for example, you cannot appeal if you just found the ticket at your door. That is a different process.

The Best Way to Know Whether to Appeal

First read the book, Smile for the Speed Camera--Photo Radar Exposed! by author/attorney Susan Kayler. Get your copy by CLICKING HERE. There is a chapter that gives you information about what kinds of issues are used in appeal cases.

Second read the cases posted on this website under "Cases Won." These are just a sampling so you'll get an idea of what kind of issues are appealed and what arguments win on appeal.

Third if you are still not sure and would like to have an attorney review your case and give you an idea of whether you have an issue to appeal, contact us with the following information:

  • Your name, phone number and email address
  • The name of the city that issued the ticket, the date of the ticket, the date of service, if any, the date of a hearing, if any
  • Details about your case, i.e., what happened, how were you served, what did you do?
  • What are the issues that trouble you with the case? What issues do you think you would like to appeal?
  • Anything else we need to know about the way the hearing was conducted, who testified, anything else
  • Send this information to Contact@photoradarlaw.com. We will review your email and most likely, we will contact you with some questions.

    If we read your email and realize right away that there is really no chance to win on appeal, we will let you know our opinion of that. If we need to see the court's file for your case and listen to the CD of the hearing then we will advise you and there will be a charge for further review. In addition, we will tell you how to obtain the information we need to further evaluate your case.

    If you feel you have a case that you would like to appeal, please follow the steps first and if necessary, contact us. There are important court deadlines and you should make sure you are aware of those and that you stay within those deadlines regardless of whether you hear from us or not. Sometimes people will contact us at the last minute and we cannot always be available to help on such short notice. It is your responsibility to decide whether to appeal and to make sure you meet all court date dealdines.

    Keep in mind that if you are asking us to review your situation without paying attorney's fees, the most we may be able to do for you is to say that we don't recommend appealing the case or that we need more information.
